Eligibility Criteria for British Naturalization

Life in the UK Test: “You need to pass the Life in the UK test, which assesses your knowledge of British customs, traditions, and history.”

English Language Proficiency: “You must demonstrate proficiency in English through an approved language test or by holding a degree taught in English.”

Good Character: “You must have a clean criminal record and not have breached any immigration laws.”

Residency: “You must have lived in the UK for at least 5 years (or 3 years if married to a British citizen).”

Absence Limits: “You should not have been absent from the UK for more than 450 days during the 5-year period (or 270 days during the 3-year period if married to a British citizen).”

Case Study

Our client had been granted indefinite Leave to remain over fifteen years ago. However, she was reluctant to apply for citizenship as she was unable to satisfy the requirements for English langange and Life in the Uk under paragraph 2(e) of Schedule 1 to the British Nationality Act 1981.

After a consultation we learnt the client was suffering from a long-term illness which prevented our client to partake in studies. We gathered the relevant documentation and represented our client to Home Office. We argued:

  1. The applicant meets all the other relevant criteria for British citizenship under section 6 (2) British nationality Act 1981 
  2. We explained she would never be able to satisfy the criteria under paragraph 2(e) of Schedule 1 to the British Nationality Act 1981.

The home office considered our submissions and granted citizenship within three months without our client satisfying the language and the Life in the UK requirement.
