EU Family Permit Case Study
Our client left Kenya when she was fourteen and moved to the United Kingdom. She constantly visited Kenya, where she got to see her fiancé, they were childhood sweethearts. They and their families decided they will marry once she complete her university education. They booked the tickets for may 2020 but flights were cancelled due to Covid-19. They had married via proxy.
When they submitted an application to the Home Office. Their application was refused due to the marriage not being legally recognised. We then represented them to the Home Office; our arguments included:
1) The marriage was legally recognised in Kenya therefore valid under Regulation 7 of Immigration (European Economic Area) Regulations Act 2016.
